These Terms and Conditions along with the disclaimer and the Privacy Policy as maybe amended and supplemented, from time to time, constitutes a legally binding financial services end-user license agreement between Sunrise Virtual School (“SVS”) and you i.e. the visitor (“Visitor”) for using the financial services of SVS and sharing certain data through the website (“Website”) or SVS online platforms and its employees (“Company”) or dashboard of representatives of SVS (“representative”) you must read and accept all of the terms and conditions in and linked to the Privacy Policy. We reserve the right at any time, at our sole discretion, to change or otherwise modify the Terms of Use without prior notice.
ACCEPTANCE OF TERMS AND MODIFICATION THEREOF

If the Visitor does not agree with any of the Terms and Conditions and the Privacy Policy of SVS, the Visitor must not access the Website. This Terms and Conditions constitutes a binding contract between the Visitor and SVS with regard to the access and use of the Website.

In the event of such a merger, acquisition, or sale, the Visitor’s continuous use of the Website signifies the Visitor’s agreement to be bound by the Policies or otherwise any new policy incorporated by the Website’s subsequent owner or operator.
SVS reserves the right, in its sole discretion, to terminate the access to the Website and/or any of the Services or any portion thereof at any time, without any prior notice.
That no discount or free gift or any other commitment whatsoever is given to customers by SVS or any of its authorized representative(s) other than what is documented herein.
SVS shall not process incomplete/defective website form, for which if any loss or delay is caused to customers, customers will not hold SVS liable for such loss or delay.
That submission of request of admission or registration of learner does not on the website to SVS does not imply automatic approval or admission and SVS. SVS in its sole and absolute discretion may either sanction or reject the website for granting the admission.
That the visitor shall read this terms and conditions alongside the admission policy as an annexures to this terms and conditions.

The Terms and Conditions herein shall apply equally to both the singular and plural form of the terms defined. Whenever the context may require, any pronoun shall include the corresponding masculine and feminine. Unless the context otherwise requires, the terms “herein”, “hereof”, “hereto”, “hereunder” and words of similar import refer to these Terms and Conditions as a whole.
VISITORS
By submitting the Visitor’s information including any personal information on the website, the Visitor expressly consents to the transfer of such data to SVS, and to the processing of such data on the server of Branch, where the Visitor’s data will be governed by laws of Kenya (“Applicable Laws”).

For the removal of doubt, it is clarified that the Services, including the use of the Website, is not for commercial use but is specifically meant for personal use only of the Visitor.

The Visitor’s undertakes that the Visitor shall not:
create or submit anything that is unlawful, pornographic, defamatory, libelous, obscene, threatening, harassing, discriminatory, bullying, vulgar, indecent, profane, hateful, racially, culturally or ethnically offensive, or that encourages criminal conduct, or that gives rise, or potentially gives rise, to civil or criminal liability, or that violates any applicable laws, rules, regulations or Government of India’s guidelines or that infringes or violates other parties’ intellectual property rights or links to infringing or unauthorized content;
re-publish, maintain and/or display any Website content on any website or other Internet location that ordinarily contains or hosts content that is unlawful, pornographic, obscene, defamatory, libelous, threatening, discriminatory, harassing, bullying, vulgar, indecent, profane, hateful, racially, culturally or ethnically offensive, or that encourages criminal conduct, or that gives rise, or potentially gives rise, to civil or criminal liability, or that violates any Applicable Laws, or that infringes or violates other parties’ intellectual property rights or links to infringing or unauthorized content;
send spam, chain letters, or any other unsolicited or unauthorized advertising or promotional materials, or to harass, bully, stalk, harm, or otherwise cause mental or physical distress or injury to anyone, or to defame or disparage someone, or for any other unlawful or objectionable (as determined by SVS) purpose;
provide false information about him or anyone else (including, without limitation, if and when the Visitor are being asked on the Website to provide accurate information about the Visitor’s age), and the Visitor will not impersonate or appear to impersonate anyone else or otherwise misrepresent the Visitor’s affiliation with any person or entity;
use any one or more of the Licenses (as defined below) to collect, obtain, compile, gather, transmit, reproduce, delete, revise, view, display, forward, any material or information, whether personally identifiable or not, posted by or concerning any other user of the Website, unless the Visitor would have obtained prior permission from such user to do so;

do anything on the Website that would prevent other users’ access to or use of the Website or any part thereof; and
The Visitor and/or the advertising agency or agent of the Visitor represents and warrants that it has the power and authority to execute, deliver and perform its obligations under these Terms and Conditions and all necessary corporate, shareholder and/or other actions have been taken by it to authorize such execution, delivery and performance, and that this Terms and Conditions constitutes its legal, valid and binding obligation, enforceable in accordance with its terms. The execution, delivery and performance of its obligations under these Terms and Conditions does not and will not contravene any laws, regulation or order of any authority or other official body or agency or any judgment or decree of any court having jurisdiction over it or conflict with or result in any breach or default under any document binding upon it.
The Visitor represents and confirms that the Visitor is of legal age to enter into a binding contract and is not a person barred from accessing and using the Website and availing the Services under the laws of India or other applicable law.

SVS does not endorse any advertiser on its website in any manner. The Visitors are requested to verify the accuracy of all information on their own before undertaking any reliance on such information.
SVS shall not be responsible for the delay or inability to use the website or the Services, the provision of or failure to provide the Services, or for any information, software, products, services and related graphics obtained from SVS through the website, whether based on contract, tort, negligence, strict liability or otherwise. Further, SVS shall not be held responsible for non-availability of the website during periodic maintenance operations or any unplanned suspension of access to the Website and/ or the Services that may occur due to technical reasons or for any other reason whatsoever. When you register with the Website, SVS or any of its partners/ affiliate/ group companies may contact you from time to time to provide the offers/ information of such products/ services that they believe may benefit you.
DECLARATION
The Visitor hereby confirms and records that the contents of these Terms and Conditions have been read out and explained to the satisfaction of the Visitor. The Visitor agrees to abide by the same at all times.
Visitor hereby authorizes SVS to carry out which due diligence on the information client may provide on SVS website or the portal.
Visitor hereby declare that all the information voluntarily furnished by him is true, correct and complete and confirms that Visitor will not hold SVS or any of its officials responsible in case of any incorrect information provided by him.
Visitor hereby confirms that they use whatever proprietary information, designs, formulas, business model etc, that they learn on SVS website and portal to instigate competition or to circumvent SVS business.
Visitor hereby agrees that they will not use materials shared by SVS on their website or portal to maliciously cause harm to SVS or employees or clients or other people through misinformation, disinformation or misconstrue or misrepresent the such on social media or any kind of media and agrees that the visitor will be held liable to the degree SVS can proof that such malicious actions has costed them business revenue.
NON-COMPLIANCE
If the Visitor breaches the terms & conditions/Policy on Website Use in any way, or if we suspect that you have breached these terms & conditions/Policy on Website Use in any way, SVS may take necessary steps as follows:
send one or more formal warnings;
temporarily/permanently block the Visitor’s access to the Website;
block all computers/devices using such Visitor’s IP address from accessing the Website;
request such Visitor’s internet service providers to block your access to Website;
commence legal action against such Visitor, for recovery of amounts due or damages arising out of your breach of terms & conditions/Policy on Website Use; and/or
suspend or delete such Visitor’s account on Website.
The Visitor herein agrees to indemnify and hold SVS harmless from and against any and all claims, action, liability, cost, loss, damage, endured by SVS due to the Visitor’s access to the Website.
